Before going to trial, cases may be referred for arbitration, mediation or a mini-trial. A major function of the pretrial process is to encourage the parties to settle the case before it gets to trial. In arbitration, the attorneys present abbreviated versions of their cases and the arbitrators render a decision on who is liable and in what amount. The arbitration gives the parties and their lawyers an independent assessment of the strengths and weaknesses of their cases. Even if both parties don’t accept the arbitration award, it may provide a reference point for settlement negotiations. Because of the accelerated and complex process used in ADR, it is critical that the attorney you select to represent your side is articulate, skilled and well-organized.
